Below are the terms and conditions as applied to the use of this website and participation on courses.

Regretfully, these are necessary in this increasingly litigious world; as common sense is no longer common
and people appear to be no longer able to take responsibility for their own thoughts, behaviour or emotions.
This includes, but is not limited to, 'Health and Safety' concerns.

All course leaders have Professional Indemity or Public Liability Insurance.

2. Acceptance of Participation in Training Courses

I agree to use the information distributed by Odyssey Ltd. in various media for the purposes of self-improvement or to achieve a positive outcome when working with other people. I understand these techniques and strategies requires respect, care, and integrity for the highest intention of myself and other people.

I accept complete responsibility for my wellbeing at all times. To the best of my acknowledge, I am a healthy individual, as physically and psychologically fit to participate in the training and I know of no reason, nor have I been informed by any medical personnel of any such reason not to participate.
I understand that although the training may raise emotional issues, Any training is not intended to provide a therapeutic environment or be a substitute for counselling or psychotherapy and that unresolved issues which may surface may require counselling, of which, I shall address appropriately by my own means.

I acknowledge that any media included as part of the training schedules and all rights - including intellectual property rights - are the sole property of Odyssey Ltd. or others from which such rights have been derived and are for the use of Odyssey Ltd. and may not be used elsewhere without obtaining prior permission.

I also acknowledge that I have carefully read and understood this agreement, and that Odyssey Ltd. agrees to provide the training referred to in consideration of my participation and payment of the fees as set out in the booking form.

3. Terms and Conditions of Booking on Public Seminars

Booking by Credit/Debit card is by secure online connection only. Cheques and Invoices may be send to:
'Freepost Learning.' (No address or postcode needed).

The Fees cover the training and learning materials. Joining instructions will be sent to the delegate in acknowledgement. Payment must be made before attendance at the event.

Cancellations The following scale applies:
21 days prior to event No Charge
21- 8 days beforehand 50%
7 days 100%

As this is the real world; substitution can be made at short notice. Please call with arrangements as soon as you know.

The booking form is a contract. For any reason beyond the control of Odyssey Ltd, dates, timings, and trainers may be changed. If we cancel an event, a refund will be made without penalty or further liability to the purchaser.

4. Website Terms and Conditions

Site terms
The terms and conditions set out here are intended to be as comprehensive as possible but by the very nature of emerging and evolving law cannot be guaranteed to be complete. The terms and conditions set out here are those that cover the conduct and content of the site and supersede any conditions expressed or implied within the membership controlled parts of the site. Any visitor wishing to apply a term or condition to the content of this site should seek permission to do so first.

Privacy
Odyssey Ltd will take appropriate steps to protect your privacy. Whenever you provide sensitive information, we will take reasonable steps to protect it. We will also take reasonable security measures to protect your personal information in storage.

A visitor’s name and email address will be available to other visitors in certain circumstances - such as a facility like a bulletin board. When a visitor views another visitor’s profile, the viewers email address is tracked and listed for the viewed member. All facilities are 'protected' as far as possible, with no general public access.

A visitor can request to have their details removed (made invisible) from the site whilst still remaining a member. This may impact on member details being removed from parts of the site. Odyssey Ltd cannot be held responsible for member details being copied or cached by other search engines, web sites, companies or individuals and where the removal of personal information is outside the control of Odyssey Ltd.

We will not provide any of your personal information to other companies or individuals without your permission. However, we may need to provide your name and address to third parties that Odyssey Ltd uses for the purposes of delivering specific services to you (e.g., online support). Odyssey Ltd will on occasions disclose to members the names of companies that have members of staff listed on the database but not the personal information of the individual staff members.

Site content
Odyssey Ltd reserves the right to monitor the data, information and files stored on the site and to remove without notice any data, information or file that is erroneous, illegal or in contravention of the sites own policies, subject to an appeal.

Log files
Odyssey Ltd servers log all visitors to the site enabling the Odyssey Ltd administrators to track user activity. This data is only used for internal purposes and can be used for site development purposes and dispute resolution.

Disability Discrimination Act

Odyssey Ltd acknowledges the need to provide a usable service under the terms of the DDA. Odyssey Ltd has implemented a number "styles" for the site to include, alternative representation and non-frame versions and others.

Links
The Odyssey Ltd web site provides links to third party sites. Since we do not control those websites, we cannot be held responsible for the content therein and we encourage you to review the privacy policies of these third party sites. Any linked web site that is found to provide inappropriate information or data will not be included in the Odyssey Ltd links page. UK regulations apply to the content of this site and Odyssey Ltd reserve the right to omit for inclusion any site that does not comply.

Cookies
The Odyssey Ltd web site uses cookies for various reasons. Cookies enable us to track information during user sessions on the website. These cookies do not track individual information. Cookies from Odyssey Ltd can only be read by Odyssey Ltd. If you choose to disable cookies in your browser, you will not be able to use certain elements of the Odyssey Ltd web site. Third party cookies are used to enhance browsing. See Google, PayPal and Amazon's policy on these. No tracking cookies are employed to monitor browser history offsite.

Technical support
The Odyssey Ltd web site has been optimised to be compatible with most recent web browsers. If you have a problem with the facilities of the site, by all means, contact Odyssey Ltd. Technical support enquiries are to be made direct to webmail@odyssey.ltd.uk. Please also check that your web browser and computer is set up correctly before contacting Odyssey Ltd. On confirmation that there is nothing wrong with its own systems and database, no further support should be expected from Odyssey Ltd unless you are entitled to support. Odyssey Ltd cannot be held responsible for the configuration of a visitor's web browser.

Data storage
Any information that Odyssey Ltd needs to store and process will be carried out on databases located in the UK. These storage services are owned and maintained by Odyssey Ltd's Hosting Service Provider. Odyssey Ltd has virtual control over the content but not physical control over the infrastructure. Odyssey Ltd downloads the database periodically for both backup and statistical analysis purposes. The offline data is secured on our office server and is password protected.

Membership
When you use the 'Join' forms, you agree to the terms laid out here and elsewhere on the site and opt in to the processes and procedures set up to facilitate contact between members of the training community on facilities such as a Bulletin Board.

Membership of Odyssey Ltd may be temporarily suspended whilst investigations are carried out into member activity that is deemed by Odyssey Ltd to contravene the terms laid out here and elsewhere on the site or whilst a complaint is being investigated. Permanently suspended members can appeal and the process is as follows:

A paper board, with each party (member and Odyssey Ltd) providing no more than 3-sides of A4 as a 'statement of case' together with supporting evidence, including statements of the rules applicable. This is then put forward to an independent arbitrator who would review the papers and provide a written ruling within 7-days of receipt. The loosing party may be held liable for the costs in the appeal process.

In compliance with the Data Protection Act (DPA), Odyssey Ltd operates a Suppression List. Odyssey Ltd who directly request to be removed from the database, have all their personal details and associated files and or information deleted from the active database, and their name and email placed on a suppression list. This ensures that Odyssey Ltd does not re-contact via other methods as the suppression list is checked for marketing purposes. Members will also be placed on the suppression list for a number of other reasons. These include:
Purging of all dormant users,
Returned emails,
Non compliance with data cleaning requests including confirmation of profile details, or
Contravention of terms of the site.
A member wishing to rejoin the the website facilities (have their name and email removed from the suppression list) should apply by email indicating how their situation has changed. Automatic re-instatement is not guaranteed. Perceived misuse of the suppression list will result in a denial of re-instatement.

Personal information
Odyssey Ltd requires that visitor information is true, accurate and up to date. Bulletin Board visitors (BBV) require full contact membership details and entering non attributable information is not permitted. BBV found with questionable information will have their profile disabled, pending a review of the data held. Visitors must maintain the accuracy of their information by updating the directory if and when there are any changes to personal details. BBV can do this in the Edit Membership page. If you have any difficulties please send an e-mail to enquiries@odyssey.ltd.uk. BBV who have a suspect e-mail address (indicated by messages being bounced back as undeliverable) will be periodically removed from the Odyssey Ltd database. These users will need to contact Odyssey Ltd to be able to gain access to certain elements of the Odyssey Ltd web site. When a member requests to be removed from the Odyssey Ltd database, all personal information is removed from the active database along with all related entries. Odyssey Ltd endeavours to do this within 24 hours. BBV found abusing or attempting to cheat the facilities on the website will be removed permanently.

Resources, photos and other works
Odyssey Ltd cannot be held responsible for determining the legitimacy or ownership of any work stored or displayed on the site. It is assumed that anyone storing or displaying material is the legal owner of that material and has sought rights to copy the material to the site. This covers resources, photographs, logos and any other work that can be deemed to have ownership.

Dormant Visitors
Odyssey Ltd will without notice, periodically remove dormant visitor details. A visitor is deemed to be dormant when they have not visited the site for a period of 365 days. A dormant user can be re-activated. To do this email Odyssey Ltd with details of the account to be re-activated

Downloads / Resources
The Resources/Downloads section of the site is for visitors to experience and use training materials.

Odyssey Ltd cannot be held responsible for determining the usability or compatibility of any downloadable resource or file stored or displayed on the site. Any member downloading a file from this site does so at their own risk. Odyssey Ltd would like to hear of any resource that does cause a problem so that measure can be taken to rectify the situation. That end use of these resources by members is at their own risk.

Resources are copyright - including intellectual copyright protected rights. Re-selling, transmission, copying, and marketing of said material is expressly forbidden without permission. Visitors are able to download Resources.

Some of these Resources will be free to download. Other Resources are for sale. Odyssey Ltd will offer for sale, Resources at a price, to the customer that will be determined by Odyssey Ltd. When a Resource is purchased by a customer, Odyssey Ltd will have effected a sale of the resource to the visitor.

Resource disclaimer
Visitors are able to download resources. These Resources will be either free or for sale. Odyssey Ltd. cannot be held responsible for any effect caused by the use of these Resources. Whilst Odyssey Ltd will take every care to ensure that Resources posted are sound and do not contravene any law, Odyssey Ltd cannot guarantee this. If a Resource is found to be doubtful in nature, its presence on Odyssey Ltd will be suspended, subject to investigation. Customers downloading Resources do so at their own risk and exonerate Odyssey Ltd from any liability.

E-zine disclaimer

E-Mails and spam filtering
Odyssey Ltd. sends out emails to visitors and trainees. Whilst care is taken in the construction of each message and all messages are legitimate within the terms of this site, Odyssey Ltd. cannot guarantee that the messages sent will reach the recipient. It is the responsibility of each Odyssey Ltd visitor or trainee to ensure that their own email systems, including spam filtering facilities, are configured to receive messages from the site. Odyssey Ltd. does not as a rule confirm that its emails are legitimate. Odyssey Ltd. reserves the right to remove email account details that return email messages undelivered.

Email messages to Odyssey Ltd are not confidential unless expressly identified as Private and Confidential or Legally Privileged. Odyssey Ltd. reserves the right to re-publish them in part or in their entirety anonymously for discussion purposes.

Customer account settlement terms
Customer account balance raised by invoice should be settled within 14 days. Failure to settle invoices in a timely manner will result in the withdrawal of services and will incur a service charge to a value no greater that 10% of the outstanding value.

Spam and Spamming
Unauthorised harvesting emails from the Odyssey Ltd. site for the purpose of selling products or services is not permitted. The sending of unsolicited emails to an individual for the purpose of selling a product or service is in direct contravention of the EU Directive on Privacy and Electronic Communications. This is classed as Spamming. Odyssey Ltd. reserves the right to investigate this practice with the relevant authorities and take appropriate action. This may include the removal of an Odyssey Ltd. visitor's privileges from the site if they are found to be in contravention of this rule.

Site abuse policy
Please be aware that this directory is administered and used by people and as Odyssey Ltd. endeavours to treat its visitors with respect. Visitors should also treat staff and other visitors with respect. Odyssey Ltd. runs a zero tolerance policy and will not tolerate abusive, insulting or other flaming emails. Identification of any such email will result in the visitor's account being disabled, pending a review of the content. If the content is found to be inappropriate Odyssey Ltd. reserve the right to delete the visitor from the database and add them to an exclusion list.

Site features and facilities
The use of any of the facilities on the site is not guaranteed and any facility, whether free or paid may be withdrawn at any time. Taking out a payment at any point in time does not constitute a contract for Odyssey Ltd. to continue to provide the same level of features and facilities in place at the time the payment was made. Developments to the site are ongoing and facilities that are currently free may become part of a paid service. Options that are current within a particular option may be moved to another option. This includes from one level of payment to another level of payment, or from a payment to a free option. Odyssey Ltd. will however endeavour to give notice of these changes, but cannot guarantee forewarning.

Alterations
The above terms and conditions may be changed without notice to comply with regulations. This may result in facilities or approvals being withdrawn without notice in order to comply with the regulations that govern the operation of this site. Odyssey Ltd. will however endeavour to notify visitors affected by the alteration.

No Waiver
Odyssey Ltd's failure to insist upon strict performance of any provision of these Conditions shall not be deemed to be a waiver of its rights or remedies in respect of any present or future default of visitors in performance or compliance with these Terms and Conditions

Force Majeure
Odyssey Ltd. cannot be liable for any breach of its obligations contained above resulting from causes beyond its reasonable control including but not limited to fires, floods or damage (of its own or other premises) insurrection or riots, embargoes, destruction of or delays in transmission, inability to obtain supplies and raw materials requirements or regulations of any civil or military authority (an 'Event of Force Majeure').

Odyssey Ltd. agrees to give notice forthwith to its visitors upon becoming aware of an event of Force Majeure such notices to contain details of the circumstances giving rise to the event of Force Majeure.

If a default due to an event of Force Majeure shall continue for more than 28 days then the party not in default shall be entitled to terminate the above terms. Odyssey Ltd. shall not have any liability to its visitors in respect of the termination of this agreement as a result of an Event of Force Majeure.

Jurisdiction
The laws of the United Kingdom apply to the jurisdiction and governance of this site.
